Terms of Use
Obtaining Access
Access to the Site is restricted to customers that are already in an ongoing business relationship with one of Avnet’s subsidiaries and affiliates/brands (e.g. Avnet Silica, Avnet Abacus, EBV Elektronik) (“Customer”) and is granted and withdrawn at the sole discretion of Avnet.

You are required to provide a valid email address, which we shall use to communicate with you e.g. regarding the status of your order, advise you regarding shipment of product backorder, and to provide you with any other notices, disclosures or other communications relating to your order.
Should you fail to provide a valid email address and update it immediately if necessary, and in the event that your email system, by its spam filters or other hindrances, impedes the proper receipt of our communications, Avnet will not be liable for any damage you incur.
Each Avnet.com user is solely responsible for maintaining the confidentiality of their password and for all activity conducted on his/her Avnet.com account (“Account”). If your password is lost, stolen, or compromised you must immediately contact OnlineSupportEU@avnet.com. We strongly recommend that you log out of the Site and, in addition, close your browser window each time when your session was ended. This is to help preventing unauthorized persons from accessing your Account with your login details. Avnet is entitled to monitor your access credentials and, at its discretion, require you to change them within a specified period of time.
Online Accounts
Avnet may connect multiple Avnet.com users to the same company Account (“Connected User”) on Avnet.com. You and your company respectively assumes sole responsibility for all activity conducted by its Connected Users. Even though any Connected User uses his/her own email address and password to log in, Connected Users share all Account history, forecasting, pricing, and quote information and you and your company respectively consents to such sharing. Periodically, Avnet may request that your company re-authorizes its Connected Users. Re-authorization helps to ensure Connected Users’ eligibility for shared company access to Avnet.com. Unless re-authorized, Connected Users Accounts may be deleted at Avnet’s sole discretion. When a Connected User is no longer authorized to use his/her company’s Account (e.g. terminates employment), the Customer company must immediately contact Avnet´s local sales representative or OnlineSupportEU@avnet.com. Avnet will invalidate the login and password and, if requested by Customer, may provide a replacement. Customer must request revocation of the login and password immediately in any case of termination of an employee, who has used such credentials for Customer. In such cases, Customer shall notify Avnet’s local sales representative or the Online Support of such revocation. If you suspect that someone else knows or has changed your password, immediately reset it in order to avoid unauthorized usage of your Account. In case of violation against our Terms of Use, Avnet may revoke access to user Accounts at any time. In addition, Avnet will periodically examine the Accounts for inactivity and reserves the right to close Accounts, which have not been used for 6 months.
Account Security
If you are conducting a session on a public computer or are otherwise using a computer to which multiple people potentially have access, please ensure you are sufficiently disconnected and logged off the Site and the computer system you are using so as to prevent unauthorized access to your Account on Avnet.com. Never share your login credentials and make sure you change your password from time to time.
Furthermore, you assure that you will not use any technology, such as but not limited to it, robot, spider, other automatic devices with a similar purpose, or any manual procedure in order to monitor or copy the Site as such or any content and/or information contained on the Site, to access or collect data, or for any other non-permitted purpose.
Violation of the Terms of Use
Should Avnet determine at its sole discretion that your usage of the Site is (i) inconsistent with these Terms of Use or (ii) has violated the rights of Avnet, a third party or (iii) has violated the applicable law, Avnet has the right to end your access to the Site and to exercise any other right under the applicable law. Avnet may release user information about you if required by law or subpoena, or if the information is necessary or appropriate to release to address an unlawful or harmful activity.
User Created Content
On the Site, you may create or upload information, text, messages, or other data (“User Created Content”). All User Created Content must be compliant to all applicable laws and regulations, including but not limited to intellectual property rights of any third party. Avnet claims no right with respect to User Created Content. Should you make visible User Created Content to other users of the Site, you grant Avnet a worldwide license to use, host, store, reproduce, modify, communicate and distribute such User Created Content. You represent and warrant to Avnet, that you are authorized to grant such license to Avnet. Such license shall survive even if you stop using the Site (e.g. forums).
Intellectual Property
The materials on this website are provided with "Restricted Rights". Use, duplication, or disclosure by the U.S. Government is subject to restrictions as set forth in applicable laws and regulations. Use of the materials by the U.S. Government constitutes acknowledgement of Avnet's proprietary rights in them. No other governments are authorized to use the materials appearing on this website without prior written permission from Avnet. All trademarks, service marks, logos, slogans, domain names and trade names (collectively "Marks") are the properties of their respective owners. Limitation Of Liability
By accessing the Site you assume all responsibility and risk for the use of the Site and the internet in general. Avnet shall in no event be liable for any direct, special, indirect or consequential damages or any damage whatsoever. It is the Customer`s responsibility to verify any information or service provided, before relying on it. The content of the Site may be out-dated, include technical inaccuracies, be in-complete, or contain typographical errors. The content of the Site may be updated from time to time without notice.
Indemnity
Should any third party raise a claim against Avnet due to your use of the Site, you agree that you will indemnify Avnet and hold Avnet, its agents, its officers, its partners and its employees, harmless from any loss, liability, claim or other demand.
Commercial Terms
All sales and Orders generated via the Site are subject to Avnet's Standard Sales Terms and Conditions, unless as otherwise stated on the respective Avnet sales site under which you choose to conduct business with Avnet (“Site”). Avnet's Standard Sales Terms and Conditions are available at https://www.avnet.com/emea/about-avnet/terms-and-conditions-of-sale/. Promotional offers and prices are valid for a limited time or as specified. Prices are subject to change due to manufacturers’ price increase, change in exchange rate or quoting errors. Please consult with your local Avnet representative for up-to-the-minute information.
Product prices and configuration are subject to change without prior notice. Stock position and published resale pricing are updated daily. Inventory availability, published resale pricing, and manufacturer quoted lead-times are subject to change at any time without prior notice.
Order Cancellation
Order cancellations are subject to an existing agreement between Customer and Avnet or subject to prior approval by Avnet at its sole discretion and cannot be processed via the Site. Please directly contact your local Sales representative.
Product Return
Avnet’s Standard Terms & Conditions of Sale apply to any product return on the basis of an order generated via the Site. In order to facilitate the processing of returned goods please reach out to your local sales representative or alternative contact onlinesupportEU@avnet.eu. Please do not return goods to Avnet without an accepted RMA case.
Forecast Information
The Site provides certain information relating to the forecast, which you as our Customer has provided to Avnet, given and based on a valid and written reserving forecast agreement with Avnet, which is a conditions precedent to access to forecast information, and have elected to view the status of such forecast demand on the Site (“Forecast Information”). Such Forecast Information is subject to the validity and terms and conditions defined in such forecast agreement. Decision on access to the Forecast Information Site in the portal resides with Avnet. The provided Forecast Information includes projections and other predictive statements that represents Avnet´s assumptions and expectations in light of then currently available information or rather information provided by the relevant manufacturer from time to time. The Forecast Information is based on industry trends, current lead times which may change at any time, circumstances involving manufacturer and other actions, and they involve risks, variables and uncertainties. Avnet factual delivery dates as well as anticipated deliveries and services’ performance dates may fundamentally differ from the projected Forecast Information provided. Consequently, Avnet does not guarantee, nor warrant, nor confirm the accuracy of the Forecast Information and Avnet disclaims all representations, warranties and liability under any theory of law with respect to the provided Forecast Information. Any information related to the Forecast Information is provided by Avnet on an “AS IS” basis and any Forecast Information, information etc. is subject to change at any time without notice. It is the Customer’s responsibility to ensure that Customer’s forecast provided is as accurate as possible. Updated Forecast Information data is available approximately on the next day, after Customer’s forecast has been uploaded on the Site.
Governing Law and Venue
Should any dispute arise out of the use of the Site, you agree that it will be governed by the laws of State of Arizona, United States of America, without regards to its conflict of law provisions. In such event, you agree that the dispute shall be brought before the courts of Phoenix, Arizona, United States of America.
